Students and Professors Have 1st Amendment Rights.


In United States v. Cassidy, the U.S. District Court for the District of Maryland found that the Constitution protects anonymous online posts.  The defendant was charged under a federal stalking statute in which he was alleged to have harassed a person by using "an interactive computer service to engage in a course of conduct that caused substantial emotional distress to a person…"

The court stated that ''Even though the Internet is the newest medium for anonymous, uncomfortable expression touching on political or religious matters, online speech is equally protected under the First Amendment as there is “no basis for qualifying the level of First Amendment scrutiny that should be applied” to online speech. Reno v. Am. Civil Liberties Union, 521 U.S. 844, 870 (1997)."
